So the State’s power to react must be the same as the power diffused throughout society.

Certainly, in none of these examples does the punishment appear unjust; if it were contrary to custom, it could not have been established. But although it is not rejected by public opinion, such opinion, if left to itself, would either not demand the punishment at all, or would show itself to be less demanding. So, in all cases of this type, the degree of criminality does not derive, or at least not completely, from the strength of the collective sentiments that are offended, but rather from some other cause.

When it is one of the elements of the latter that determines our conduct, we do not act in our own personal interest, but in the pursuit of collective ends.
